2nd look council

Board of Variance + SQCRD(1)

Here is first look at meeting

 

 

These DVP fill up the empty spaces of Council meetings

Well done – but

 

Previous garage burned down and need to replace – Insurance will pay --- but original was too close to property line (by today’s rules) – so need permission to use the remaining foundation and rebuild

 

 

From Vancouver’s BoV page for what may be appealed 

·           any repairs to or reconstruction of a building which is non-conforming as to use where the building suffers from damage or fire loss (60% or more of its value above its foundation);

There is the legal process of informing nearby property owners etc --- But what becomes interesting about this whole process is why City Council doing it and not the recently appointed ‘Board of Variance’ (BoV)—the latter is a condition of having a zoning bylaw --- but I suspect our BoV will never meet or at least never hear an appeal ---- presumably this is because the City has taken a narrow interpretation of what constitutes a ‘hardship’ , but a little Googling shows a large amplitude on how this is applied: in one city a larger garage than zoning bylaw allowed was accepted because the proponents teenagers also had cars ---- that one already has an existing foundation would seem to me to meet criteria of ‘hardship’

I note that on the cities web site for applications to vary bylaw requirements etc – Board of Variance is not even listed – little own given a price tag

Note too bylaw presumably not updated since 1987—plus no provisions for new downtown DPAs etc

So where is the Board of Variance charge? Is it free?
