Originally
there was talk of 6 parking spaces – but presumably mall pointed out that
configuration would put parking on Mall property so parking turned parallel
to building as at ‘Typical’ on image left below. – But while there look at
the blue arrows I have imposed on
their images |

Looks to me like
there is a City owned lane entering the property that the Mall is using for
their own parking ---- but could be an artefact of drawing not properly
reflecting land sales when Mall started |

Thorkelson had a good suggestion that
about half hour of lawyer’s time be allowed for Ashley to have a generic
discussion on possible conflict—as Thorkelson had been able to get when she
was a new Councillor |

Note
left that Councillor Ashley has vacated her chair (& the room) over fear
of conflict since her employer (School Board) was mentioned. While
the discussion was long came down to a vote to table again until the relevant
policy on lawyers and conflict from Nelson BC was made available to Council
--- Bedard, Gordon Payne and Mussallem voted against tabling but lost |

Bedard wrote a letter in Jan 12th agenda package requesting
City to utilize charitable flow through tax donations (below left—note never
came to Council as Tabled)) ----then this was generalized partnering policy for
‘Tax flow throughs’ that was accepted unanimously a the 26th
meeting – to which Bedard spoke and voted in favour of |

I have
contended the policy itself
is illegal --- Mussallem told me at time that when motion passed it was
to include a report on legality – this report has not been completed as of
this date (and I doubt if it ever will) From CRA –
see my previous) Under the Income Tax
Act, donors can only obtain tax relief when they make a donation to qualified donees, which includes,
among others, registered charities. Therefore, a donor is not entitled to tax
relief when the transfer is made through a registered charity to a non
qualified donee |
Remedy??

I
am told there is only one remedy (emails from City and Province) and that is
for 10 electors to go to Supreme Court and seek to have Bedard disqualified Note
if electors win – the City must pay the electors’ costs immediately Here
