Over the line?

 

Hard to tell without accurate drawings etc

Assuming the fence in image left was along property line – then appears to be slightly beyond property boundaries

 

More worrisome – Is it safe? And what liability has City acquired by ‘allowing’ it?

 

 

Property Lines

I have used this image before when I was asking if ‘Chances’ owned land their brochure represents as belonging to them – the land subsequently changed hands at 500T$

 

I assume the base image and property lines comes from Engineering dept --- if so then Crest may not own all it’s parking lot – but Chances property line ‘juts out’ where deck is – still might be encroaching on #1 Pacific property—note the shed which appears under deck in above image

 

Safety

The decks did not appear in the early conceptual drawings --- but City staff showed me the current building plans and the decks are there – image left

 

 

 

City not Liable

What about the ‘safety concerns’?

Several people I have spoken with were concerned about safety: during heavy rains there is copious amounts water coming over the bluff at this location – plus how close can supports come to edge when problems of sufficient support emerge?

 

Speaking with building inspectors I was assured that City had not assumed any responsibility – the drawings etc were produced by an Architect and the Architect would be liable – as they did plans etc with aid of an Engineering firm etc

Plus with Commercial zoning there is no ‘set back’ requirements – so able to build to property line

 

 

 

 

Bottom Line

City squeezed between enforcing its own bylaws and ‘promoting’ business – I have pointed out other properties using/ built on City property and it has only drawn a shrug from Mayor – Plus it looks to be a hornet’s nest as perhaps the Crest using city owned property (with no compensation?) – and Crest certainly has a deck built out to edge of bluff (and over property line?)
